Ministry of Justice (MOJ)

The Ministry of Justice (MOJ) is a government department in the UK responsible for upholding the rule of law, promoting access to justice, and ensuring the legal system operates effectively. Its primary role is to oversee and develop policies relating to the justice system, courts, prisons, and legal affairs.

The MOJ has a broad range of responsibilities within the legal sector. Some of its key functions include:

  • Policy Development: The MOJ formulates and develops policies to shape the legal framework in areas such as criminal justice, civil justice, human rights, family law, and constitutional matters. It works towards ensuring the legal system meets the evolving needs of society.
  • Courts and Tribunals: The MOJ oversees the administration and management of courts and tribunals in England and Wales. It is responsible for maintaining the efficiency and effectiveness of the court system, ensuring access to justice, and supporting the fair resolution of legal disputes.
  • Legal Aid: The MOJ manages the legal aid system, which provides financial assistance to individuals who cannot afford legal representation. It sets eligibility criteria, regulates legal aid providers, and ensures access to justice for those in need.
  • Prison and Probation Services: The MOJ is responsible for managing and rehabilitating offenders. It oversees prisons, probation services, and rehabilitation programs to reduce reoffending rates and promote the successful reintegration of individuals into society.
  • Legislation and Law Reform: The MOJ contributes to the development of legislation and law reform initiatives. It works with other government departments and stakeholders to shape legal frameworks that uphold justice, protect rights, and address societal challenges.

While the MOJ previously regulated Claims Management Companies (CMCs) involved in various legal sectors, including personal injury claims, the regulatory oversight of CMCs was transferred to the Financial Conduct Authority (FCA) in April 2019. This change aimed to strengthen consumer protection and ensure CMCs operate under the FCA’s regulatory framework.
