What is an EasyJet accident claim?

An EasyJet accident claim is a type of personal injury claim that you can make if you were injured during an EasyJet flight or a package holiday booked with the company. This allows you to seek compensation for any injury or illness suffered because of negligence.

Examples of accidents that may lead to an EasyJet compensation claim include:

This guide explains how to make an EasyJet negligence claim, the time limits that may apply, and the evidence needed to support your case.

Can I make a claim following an EasyJet accident?

If you suffered an injury during an EasyJet flight or package holiday, you could be entitled to compensation. Generally, you can make a claim if the following can be proven:

    • You were owed a duty of care.
    • Your accident was caused by a breach of that duty.
    • You sustained an injury or fell ill as a result.
    • You are within the legal time limit for starting a claim.

You may also be able to make a claim on behalf of a child or loved one who is mentally incapacitated by representing them as a litigation friend.

A personal injury lawyer can assess your case during a free consultation over the phone and determine whether you have valid grounds for compensation.

When is EasyJet liable for injury?

There are two types of claims that you could make against EasyJet:

An airplane accident claim can be brought under the Montreal Convention if you suffered an injury on an EasyJet flight or while embarking or disembarking the aircraft. Under this convention, airlines are strictly liable for proven damages up to 151,880 Special Drawing Rights (SDRs) resulting from unexpected events, so you do not need to prove negligence within this limit.

You could make a holiday accident claim under the Package Travel and Linked Travel Arrangements Regulations 2018 if you were injured during a holiday booked through EasyJet Holidays. In this case, you must be able to prove negligence or a breach of duty by the tour operator or their supplier, such as:

    • Poorly maintained premises
    • Unsafe airport transfers
    • Failure to provide the promised services
    • Negligent organisation of activities
    • Poor hygiene standards
    • Inadequate health and safety checks

Whether the accident happened in the UK or abroad, you should usually be able to make your EasyJet package holiday claim in the UK, under UK law.

If you booked accommodation, excursions or other services independently, you may need to pursue a public liability claim abroad, under foreign law.

How do I make an EasyJet compensation claim?

If you were injured during an EasyJet holiday or flight and you want to make a claim, the first step is to get in touch with an expert injury solicitor. They will review your case and ask for any supporting evidence you may have, such as medical records, photos, witness details, receipts and accident reports.

If you have a valid claim, your solicitor will handle the rest of the process and will:

    • Collect any other necessary evidence to build a strong case.
    • Arrange for a free medical exam to confirm your injuries and their long-term impact.
    • Assess the value of your claim and liaise with EasyJet to negotiate a fair compensation settlement.
    • Issue court proceedings if your claim is disputed or you cannot settle.
    • Apply for interim payments if you have urgent financial needs.

How much compensation is my claim against EasyJet worth?

The amount of compensation you may receive after an EasyJet accident and injury depends on several key factors, which are grouped into two types of damages:

General damages are awarded for your pain, suffering and loss of amenity and depend on the type and severity of your injuries. These are calculated based on the Judicial College Guidelines and could amount to:

    • £2,090 – £10,670 for a minor back injury, such as a sprain, strain or disc prolapse.
    • £10,890 – £16,380 for a shoulder injury such as a fractured humerus, clavicle or rotator cuff.
    • £10,750 – £20,900 for a serious wrist injury that causes some degree of permanent disability.
    • £15,320 – £46,780 for a moderate leg injury with partial recovery and near certainty of arthritis.
    • £344,150 – £493,000 for a catastrophic brain injury with little to no awareness and language.

Special damages cover all the financial losses and expenses incurred because of the accident or injury. These could include medical treatment costs, travel expenses, loss of earnings and care costs. This is often the bulk of the compensation in holiday injury claims.

Time limits to start an EasyJet accident claim

The time limit to claim compensation for an injury depends on how the accident occurred:

    • Package holiday claims have a 3-year time limit, starting from the date you were involved in an accident or suffered an injury. Exceptions apply to children (the 3 years begin on their 18th birthday) and individuals who are mentally incapacitated (the time limit is suspended).
    • Claims governed by the Montreal Convention generally have a 2-year time limit starting from the date of the accident.

We advise you to contact a travel claims solicitor as soon as possible to ensure evidence is readily available and your claim has the best chance of success.

Can I make a claim on a no win no fee basis?

Yes. If you are entitled to compensation, our legal team will help you make your claim on a no win no fee basis. This means that you will not be asked to pay any legal fees upfront or if the claim is unsuccessful, so there is no financial risk to you.

If you get the compensation you deserve, your solicitor is entitled to a success fee. This fee is a percentage of your settlement for past financial losses and general damages, capped by law at 25%. Your future losses are not affected by it.

What evidence do I need to prove my claim against EasyJet?

Your solicitor will need various types of evidence to build and win your case. This must prove how the accident or injury was caused and the impact on your life. Key supporting evidence includes:

    • Medical evidence – This is key evidence for your claim because it proves the nature and severity of your injuries, how long recovery is expected to take and any long-term effects. A medical report from an independent specialist is also often obtained.
    • Photographic evidence – Photos and videos of the accident scene, hazardous conditions and visible injuries can help prove negligence. If available, CCTV footage can provide an undeniable account of what happened.
    • Accident reports – You should formally report the accident to the airline, tour operator or business where the incident took place. Ask to have it recorded and request a copy where possible.
    • Witness statements – Testimony from independent witnesses can significantly strengthen your claim. You should ask for the names and contact details of anyone who saw what happened so that your solicitor can contact them later for a statement.
    • Proof of financial losses – You will need financial documents to claim back all the losses and expenses incurred because of your accident. This may include payslips for lost wages, receipts for travel expenses and invoices for medical treatment or care costs.
    • Booking documentation – You should keep your flight confirmation, package holiday details and any communication with your travel agency that could help establish liability.

Don’t worry if you don’t have everything you need to support your claim, as your solicitor will be able to obtain evidence on your behalf.

What injuries are covered by EasyJet compensation claims?

Compensation claims against EasyJet can cover a wide range of injuries, provided that they were caused by negligence during a flight or package holiday. These include:

    • Gastric illnesses caused by poor hygiene or contaminated water
    • Bed bug infestations causing bites, rashes and other skin issues
    • Burns and scalds from hot liquids, fires or electrical hazards
    • Soft tissue injuries from slip and trip accidents
    • Broken bones from falls, road traffic accidents or excursion accidents
    • Heatstroke and sunburn from poorly planned outdoor activities
    • Severe injuries such as brain trauma, spinal injuries or amputations
    • Drowning and near-drowning injuries

You can often still claim compensation even if you were partially at fault for the injury or accident that occurred, such as by ignoring a clear warning sign. Under contributory negligence rules, you are allowed to make a claim, but your compensation may be reduced to reflect your part of the blame.

Can I still claim if I accepted a goodwill gesture from EasyJet?

Yes. You can often still make a claim even if you have been offered and accepted a voucher or refund, as long as this was not explicitly linked to a clause waiving your right to claim further compensation.

A goodwill gesture from the company is a voluntary offer meant to express support and empathy for your situation, and not an admission of guilt or liability. If you later make a successful claim, the value of the goodwill gesture may be deducted from your final settlement.

Call 0800 470 0474 today or request a call back to find out if you could be entitled to claim for an EasyJet accident. A specialist package holiday claims solicitor will assess your case for free, answer all your questions, and offer you a no win no fee service if you decide to proceed.
